U.S. STATE PRIVACY NOTICE

In addition to the rights provided above, you may have certain additional rights with respect to your personal information, as described in this U.S. State Privacy Notice (this “Notice”). The terms of this Notice may apply to “consumers”, “natural persons”, or other similarly situated individuals as identified by terms defined under privacy laws enacted in one or more U.S. States, including, without limitation, in California, Colorado, Connecticut, Florida, Oregon, Utah, and Virginia (collectively, “U.S. State Privacy Laws”). This Notice is a supplement to our other policies or notices for visitors to our website, including, without limitation, our Privacy Policy and our Terms of Service.

This Notice applies to you only if you and/or we meet an applicable definition set forth inone or more U.S. State Privacy Laws which would have the effect of granting you or us certain rights with respect to your personal information or data pursuant to a given U.S. State Privacy Law. For example, if you do not meet the definition of a “consumer” or an “individual” under a U.S. State Privacy Law, or if we do not meet the definition of a “business” or a ”controller” under the same U.S. State Privacy Law, this Notice does not apply to you or to us. This Notice also does not apply to your personal information or data that is not treated as “personal information”, “personally identifiable information”, “personal data”, or a similar term defined or referred to in one or more U.S. State Privacy Laws. This Notice also does not apply to information collected by third-party content, websites, applications, platform, code (e.g., plug-ins, APIs, and software development kits), and certain cookies and other tracking technologies; our collection and use of information through such means is covered by our Privacy Policy. Finally, where we provide our products and services to you on behalf of an institution or other third party, we process your personal information as a ‘service provider’ or ‘processor’ in accordance with our contractual agreements with that third party. In that case, the third party’sprivacy notice governs the use of your personal information. In all, this Notice only reflects how we collect, use, disclose, and otherwise process personal information for our own purposes (e.g., for our websites and marketing), when we are acting as a ‘business’ or ‘controller’ under a U.S. State Privacy Law, and only if you are considered a ‘consumer’ or an ‘individual’ under that same U.S. State Privacy Law.

This Notice is designed to provide you with notice of our data practices on our website and anywhere this Notice is posted over the period of time from the date on which our Privacy Policy was last updated to today, as required under some U.S. State Privacy Laws. Additionally, this Notice applies to our current data practices such that it is meant to provide you with “notice at collection,” which is notice of personal information we collect, and the purposes for which we process personal information, among other things as required by the U.S. State Privacy Laws. For any new or substantially different processing activities that are not described in this Notice, we will notify you as legally required, such as at the point of collection. We reserve the right to amend this Notice at our discretion and at any time. When we make changes to this Notice, we will update its effective date (which will be the date that our Privacy Policy was last updated). In the event of a conflict between any other policy, statement, or notice set forth by Tate and Taylor and the terms of this Notice, this Notice will prevail to the extent that its terms apply to your and our rights pursuant to a U.S. State Privacy Law. To the extent the terms of this Notice are not inconsistent with the terms of any other policy, statement, or notice set forth by Tate and Taylor, the terms of those policies, statements, or notices are incorporated herein by this reference. Certain terms used herein and not otherwise defined will have the meaning ascribed to them in our Privacy Policy.

We collect personal information from you as described in more detail in our Privacy Policy. Please refer to the sections of our Privacy Policy entitled KINDS OF PERSONAL INFORMATION WE COLLECT, USING AND DISCLOSING YOUR PERSONAL INFORMATION, HOW WE USE TECHNOLOGY TO COLLECT AND USE PERSONAL INFORMATION, and MARKETING AND YOUR PERSONAL for more information on how we collect and use your personal information for purposes of U.S. State Privacy Laws.

Some of the categories of personal information we collect may be classified as “sensitive” under certain U.S. State Privacy Laws, including health, biometric, and disability information (e.g., to allow us to appropriately accommodate the needs of users of our website or who purchase products or services from us). We use this sensitive information only for the purposes described in our Privacy Policy or as disclosed by you at the time of collection, and only to the extent necessary to operate our website and provide our products and services, to enter into and perform a contract with you, to comply with legal and regulatory requirements or as otherwise permissible for our own internal purposes consistent with laws.

As described in more detail in our Privacy Policy and our Terms of Service, how we use and disclose your personal information depends on your relationship with us. Please refer to our Privacy Policy and Terms of Service for more information on how we use and disclose any personal information we collect from you.

We do not sell your personal information for profit. However, we may engage in targeted advertising on our own websites (but not in our products), which may be considered a “sale” under certain U.S. State Privacy Laws. In this context, as is common practice among companies that operate online, we may permit third party advertising networks, social media companies and other third-party businesses to collect information directly from your browser or device through cookies or similar tracking technology when you visit or interact with our website or otherwise engage with us online. For example, they may collect information about your internet connection or your device, browsing history and website usage, location data; and they may make inferences generated from this information and you interactions with our services as well as other sites and services. These third parties use this personal information to deliver targeted advertising (also known as “cross-context behavioral advertising”) and personalized content to you on our website, on other sites and services you may use, and across other devices you may use, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research. To learn more, please see our Privacy Policy regarding how we use cookies on our website. If our use of your personal information is covered by this paragraph, you may also have the right to request that we disclose to you the categories of your personal information that is sold, and the categories of third parties who buy such information. Even if you have previously given us your consent to sell your personal information to third parties, you have the right to direct us not to sell your personal information at any time.

During the preceding 12 months, we have collected, used, and shared the categories of personal information described in this Privacy Policy. We do not sell the personal information of consumers we know to be less than 18 years of age or use or share such information for targeted advertising purposes.

Depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to limit or opt-out of the sale of personal information or the processing of personal information for purposes of targeted advertising (as described in the Your Privacy Rights section below).

Depending on your state of residency and the applicability of a U.S. State Privacy Law to you and us, and subject to certain legal limitations, you may be able to exercise some or all of the privacy rights described in our Privacy Policy.

If you would like to exercise your rights under this Notice or our Privacy Policy, please see the section entitled YOUR PRIVACY RIGHTS AND CHOICES. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity, including by asking you for additional information. Consistent with applicable law, if you choose to exercise your rights, we will not charge you different prices, provide different quality of services, or discriminate against you in any way for exercising your rights, unless those differences are permitted by law. If you would like to use an agent registered with your state of residence pursuant to a U.S. State Privacy Law or other applicable law to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. Depending on your state of residence, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted via email to hello@tateandtaylor.com.

In addition to the rights provided above, if you are a California resident, you may have some additional rights as described in this section. For example, California Civil Code Section 1798.83 permits users of the website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to hello@tateandtaylor.com.
